The following Conditions of Sale regulate the sale of the products sold by Meucci Claudio (hereafter ‘The Seller’) through the internet site www.cantucciodelvino.it (hereafter ‘The Site’).

All purchases of products through the above-mentioned internet site and based on the below procedures, between the Seller and the Customer, are regulated by these Conditions of Sale (in accordance with Italian legislation, in particular D. Leg. N. 70/2003 in relation to electronic commerce, and D. Leg. 206/2005 specifically relating to the governance of distance contracts. The Conditions of Sale will be promptly updated following any changes and/or additions and will be effective from the moment of their publication on the Site. These will only apply to the sales concluded after their publication. Customers are therefore invited to regularly review the Conditions of Sales.

 

 

Registration on the Site

 

The purchase of products on the Site is only permitted to registered users.

Registration credentials must be used exclusively by the user and cannot be transferred to third parties. The user undertakes not to disclose them, to ensure that no one has access to them, as well as to notify the Seller without delay in case of suspected improper use and/or disclosure of such credentials. The user guarantees that the personal information provided during the registration procedure on the Site is complete and truthful, and agrees to agrees to indemnify the Seller for any damage, liability obligation and/or sanction arising from and/or in any way related to the violation by the user of the rules on registration on the Site or on the safeguard of the registration credentials.

 

 

 

 

 

Acceptance of the Conditions of Sale

 

The contract between the Seller and the Customer concludes with the acceptance of the purchase order by the former. Acceptance is automatic, unless otherwise communicated to the Customer. By concluding a purchase through the various ways provided, the Customer declares to have read all information contained in the Privacy Policy and information provided during the purchase procedure, to be of 18 years of age or above, and to accept the conditions set out below. The Customer is therefore invited to carefully review these Conditions of Sale, to print and/or save an electronic copy and/or in any case keep the present Conditions of Sale accessible.

 

 

How to purchase

 

The Customer can only purchase products available on the Site https://www.cantucciodelvino.it

at the time the order is placed, as described in the relevant information sheets. All product support information reflects information supplied by the producers. The Seller, therefore, through the Site Cantuccio del Vino, reserves the right to modify product information as provided by the producers without prior notice. The images on the Site are supplied to the Customer to facilitate identification of the product. The image accompanying the description of a product may not be fully representative of the features of the product delivered due to changes in the packaging. Correct receipt of the order is confirmed by Cantuccio del Vino through an e-mail reply, sent to the e-mail address communicated by the Customer. Should an order not be accepted, the Seller will immediately contact the Customer. All product prices published on the Site are sale prices to the public and, therefore, include V.A.T. The Seller reserves the right to change the price of products at any time, without notice. Prices to the public do not include possible taxes and duties applicable in the country the products are delivered to, if different from Italy. These costs, different in each country, are the responsibility of the Customer, who bears the responsibility to ascertain the applicable amount of taxes and duties through the appropriate authorities.

 

Payment Methods

 

The Customer may purchase products offered on the internet Site www.cantucciodelvino.it using the payment methods indicated during the purchase procedure. Additional costs relating to the chosen method of payment will be displayed during the placement of the order.

 

In the event that one of the payment methods cannot be used in relation to a specific product, this will be clearly indicated on the Site, at the latest at the beginning of the purchase procedure. The order will be processed once payment has been verified. Please refer to Payment Methods for more information.

 

Delivery Methods

 

The Seller undertakes to deliver the products through specialised carriers. The costs of delivery are carried by the Customer, excluding any special offers of free delivery, and are clearly indicated at the time of the submission of the order.  Depending on the destination of the products, delivery to the Customer can take place between 24/36 hours and 5/6 working days, barring any delays (but no later than 30 days from the date of the purchase). It is the Customer’s responsibility to check the conditions of the products on arrival and, in case of doubts about the integrity of the product, to indicate on the carrier’s transport document any concerns.

 

The Customer has 14 calender days to verify the integrity of the product and report, in writing via registered mail with return receipt (to Claudio Meucci – Titolare di Cantuccio del Vino – Via Latereto n. 1, 52019, Laterina Pergine Valdarno – AR) or via email addressed to   vineria@cantucciodelvino.it and to P.E.C. to claudiomeucci@pec.it, any damage, corroborated  where possible, with photographs of the products’ eventual damage. The Seller will provide a refund within 14 calender days of receiving the products.

 

Information on the Customer’s Right of Withdrawal

 

The user qualified as Customer has the right to withdraw from the contract, without having to specify the reasons, within 14 calender days from receiving the product personally or from the product being received by a third party nominated by the Customer. To exercise the right of withdrawal, it is sufficient that the Customer informs the Seller of their decision through the methods of communication listed above. The Customer must return all products to the Seller at the above-mentioned address, within 14 calender days from the notification of the intent to exercise the right of withdrawal. The costs of returning the product are the responsibility of the Customer.

 

 

Period and method of reimbursement following exercise of right of withdrawal by the Customer consumer

 

The Seller, after verifying that right of withdrawal applies and confirming the integrity of the returned product – as damaged or used products will not be substituted or refunded, in full or partially – undertakes to refund without delay, in any case within 14 calendar days  after receiving products, of the decision by the Customer consumer to exercise the right of withdrawal, all payments received, with the exception of the initial costs of delivery. Where possible the refund will be made using the same means of payment used by the user for the initial transaction, unless otherwise expressly requested by the Customer. In any case, the Customer will not incur any additional cost as a consequence of such reimbursement.

 

Please note that the refund will be held by the Seller until the product has been received by the Seller, or until the Customer consumer provides proof of delivery to the Seller.

 

The right of withdrawal does not apply to tailor-made or personalised products, or to products that, by their nature, are subject to rapid deterioration or are not suitable to be returned for hygienic reasons or for reasons related to health protection, or products that have been opened or handled after delivery. The Customer is responsible only for the decreased value of the product caused by the handling of the product in a way that was not necessary to establish the nature, characteristics and function of the product.

 

Returning Products Damaged During Transport and Non-compliant Products

 

Products damaged during transport or non-compliant products are to be returned to the Seller (at the above-mentioned address), who will substitute the products. Should the products no longer be available, the Seller will contact the Customer to propose alternative products and, in case the new products are not acceptable to the Customer, to offer a refund of the costs via the methods previously indicated.

 

Limitations of Liability

 

The Seller assumes liability for the risk of delivery via carrier and is responsible for any damage to the product incurred prior to the signature for acceptance of the product. The Seller cannot be responsible in any way for delays in the delivery of the product due to missed delivery of the product itself, in the case where the delay or the missed delivery are caused by exceptional and unforeseen circumstances, such as civil unrest, intentional damages, fires, floods, storms or supernatural events, interruptions of an ISP or telecommunication provider, relating to the fulfilment of the contract.

 

 

Billing

 

By submitting an order on the Site – following the necessary registration reserved to persons 18 years and over as above – the Customer gives consent to receiving an invoice, only in electronic form.

The invoice can be printed and archived as original in accordance with Ministerial Circular

45/E, 19/10/2005. The information utilised for the issuance of the invoice is the relevant information provided by the Customer, who declares and guarantees its veracity, and commits to indemnify and hold harmless Claudio Meucci from any liability or damages, including sanctions issued by the competent authorities that may derive in case of non-compliance with the truth of such information.

 

Protection of Minors

 

The Site does not sell wine or other alcoholic products to minors. The carrier will not deliver wine or other alcoholic products to minors and may request identity documents to confirm a person’s age.

Legal Compliance  

All products sold on the Site are covered by the Legal Compliance Assurance provided for by the articles. 128-135 of the D. Leg. n. 128-135 of the Consumer Code (Legal Assurance). The Legal Assurance is reserved for consumers. Therefore, it is applied only to Customers who have made the purchase on the Site for purposes unrelated to business, commercial, craft or other professional activities. Those who have purchased on the Site and who do not hold the quality of consumers will be covered by the assurance for the defects of the product sold, the assurance for quality defects promised and essential and the other assurances provided by the Civil Code with the related terms and limitations.

 

Applicable Law and Competent Court; Out-of-court Settlement of Disputes – Alternative Dispute Resolution / Online Dispute Resolution

Contracts concluded between users of the Site and Cantuccio del Vino are governed by Italian law. The application to consumers who do not have their usual residence in Italy of any more favourable and mandatory provisions provided for by the law of the country in which they are habitually resident, in particular in relation to the time limit for the exercise of right of withdrawal the time limit for the return of the products should they wish to exercise this right and in relation to the modalities and formalities of the communication of the same and the legal compliance assurance.

 

 

 

 European Platform for Disputes Resolution

The Seller, pursuant to art. 141-sexies, paragraph 3 of D. Leg. 6 September 2005, n. 206 (Consumer Code), informs the user, holding the status of Consumer as per art. 3, paragraph 1, lett. a) of the Consumer Code, that, in the event the Seller has received a complaint that could not be resolved through negotiation, the Seller will provide to the user information about Alternative Dispute Resolution Organisations in order to resolve the disputes relating to obligations arising from a contract concluded in accordance with these Terme and Conditions of Sale (c.d. Alternative Dispute Resolution (ADR) entities, as indicated in art. 141-bis and subsequent of the Consumer Code).

The Seller informs the Customer consumer of the existence of a European platform for online resolution of consumer disputes (ODR platform). The ODR platform can be contacted at the following address http://ec.europa.eu/consumers/odr/. Through the ODR platform the consumer can access the list of ADR entities, find the link to each entity’s site, and initiate an online resolution procedure relating to the dispute in which the consumer is involved.

In any case, consumers maintain the right to refer their disputes to an ordinary competent court, responsible for disputes deriving from the application or interpretation of these  Conditions of Sale.

The user who resides in a member state of the European Union other than Italy, can also access, for any dispute concerning the application, execution and interpretation of these Terms and  Conditions of Sale, the European Small Claims Procedure by Regulation (EC) n. 861/2007 of the Council, 11 July 2007, provided that the value of the dispute does not exceed, excluding interest, rights and expenses, Euro 2,000.00.
